EPA Establishing New TMDL Limits for Chesapeake Watershed

On May 12, 2009 President Obama signed an executive order that calls for the federal government to lead a renewed effort to restore and protect the Chesapeake Bay. As a result the EPA is establishing TMDL (Total Maximum Daily Load) limits that each state in the watershed can discharge to the watersheds connected to the bay. Delaware is required to revise current wastewater and stormwater regulations to comply with the TMDL limits. This is a work in progress and the exact requirements of each new regulation are not known yet. The regulations for septic system design are already in the process of being revised and it is a sure thing that the new regulations will increase the cost of septic systems due largely to pretreatment and inspection requirements. Septic permits issued under the current regulations are good for two years. The EPA Program is described in detail at http://www.epa.gov/chesapeakebaytmdl
